Important notice

CalmSignal is a data collection and baseline modelling tool in active development. It is not a medical device. It does not diagnose, treat, prevent, monitor, or flag the onset of any medical or psychiatric condition.

Nothing on this website or within any CalmSignal product constitutes medical advice, clinical diagnosis, psychiatric assessment, or therapeutic guidance of any kind. You must not make any decision about your medical treatment or medication based on any CalmSignal output without consulting a qualified healthcare professional.

If you are experiencing a mental health crisis, contact emergency services (112), a crisis helpline, or your doctor immediately. Do not contact CalmSignal in a crisis situation.

1. Scope and Acceptance

These Terms of Use govern access to and use of calm-signal.com and all associated pages, features, content, registration forms, screening questionnaires, and early access programme activities. They constitute a binding legal agreement between the user and CalmSignal, operated by Sebastian Weber and Lucia Kedrová as an unincorporated joint venture pending incorporation of a formal legal entity (together, CalmSignal). By accessing this website or any of its features, you confirm that you have read, understood, and accepted these Terms in their entirety. These Terms are provided in compliance with Paragraphs 305 et seq. BGB governing standard business terms.

2. Eligibility and Consent Capacity

Participation in the CalmSignal early access programme is restricted to individuals satisfying all of the following conditions:

(a) Age: the individual is 18 years of age or older. The onboarding flow includes a dedicated standalone age confirmation step prior to the main terms acceptance, requiring the participant to confirm their date of birth. This step is recorded in the consent audit trail.

(b) Diagnosis: the individual has received a diagnosis of Bipolar I disorder from a qualified healthcare professional. CalmSignal cannot and does not verify clinical diagnoses. Eligibility rests on the participant's own self-declaration.

(c) Legal capacity: the individual possesses full legal capacity to enter into a binding agreement and to give informed consent to data collection and processing. A diagnosis of Bipolar I disorder does not affect legal capacity to consent under German law or EU law. By accepting these Terms the participant confirms they are consenting freely, voluntarily, with full understanding, and without external pressure or undue influence.

CalmSignal strongly recommends that participants discuss their intention to join the early access programme with their treating healthcare professional prior to registration. This recommendation does not constitute a prerequisite for participation but reflects CalmSignal's commitment to the welfare of its participants.

Users providing false eligibility information may have access terminated without notice.

3. Declaration of Product Scope

Declaration of product scope — early access programme

The CalmSignal early access programme is a personal data collection and baseline modelling activity.

The product collects biometric data from connected health applications and behavioural metadata from keyboard usage across the participant's device, constructs a personal pattern baseline for each participant, and presents visualisations of that data to the user.

The product does not flag, alert, or communicate any inference about mood states, episode onset, or any clinical condition. It is not a medical device. All visualisations are informational representations of personal data only. No clinical function, therapeutic benefit, or diagnostic output is provided or implied.

Users see their own data visualised. They draw their own conclusions. CalmSignal draws none.

4. Nature of the Website and Product

(a) CalmSignal is a technology product in active pre-launch development. The website exists to present information about the product, collect expressions of interest, and administer the early access programme.

(b) The product collects biometric and behavioural data with the user's explicit prior consent, processes that data to construct a personal baseline model, and presents visualisations of collected patterns to the user. The user is solely responsible for all interpretations arising from those visualisations.

(c) No output of the product constitutes a clinical assessment, medical diagnosis, psychiatric evaluation, risk indicator, or recommendation to take or refrain from any health-related action.

(d) Users must not modify, interrupt, or make any decision about their medical treatment, medication, or care plan based on any CalmSignal output without prior consultation with a qualified healthcare professional.

(e) CalmSignal is not a crisis service and cannot provide emergency support of any kind under any circumstances.

5. Data Collection

The early access programme collects two principal categories of user-generated data as described in full in Document 2:

(a) Health and biometric data: with explicit prior consent, CalmSignal requests read-only OAuth 2.0 access to data in the device health application including sleep, heart rate, HRV, step count, and activity levels. This access may be revoked at any time through device settings.

(b) Keyboard and typing behaviour metadata: with explicit prior consent, CalmSignal operates a custom keyboard collecting typing pattern metadata including keystroke timing, speed, error rates, autocorrect usage, and backspace frequency across all applications on the participant's device during active use. The content of anything typed is never collected, stored, or transmitted under any circumstances. Only behavioural metadata about typing mechanics is captured.

(c) Purpose: data is collected solely to construct personal baseline models and improve pattern recognition capabilities. It generates no clinical inferences, alerts, or flags.

(d) Visualisations: participants receive graphs of their own data. No raw data tables are accessible to participants. All visualisations are informational only.

(e) Retention: data is retained for product development purposes subject to annual review. Participants may request deletion at any time. Full terms are in Document 2.

6. Intellectual Property

All content on this website, including text, design, graphics, logos, source code, algorithms, and data models, is the exclusive intellectual property of CalmSignal protected under applicable German and EU law. No content may be reproduced or used commercially without prior written consent. Anonymised and aggregated insights derived from participant data may be used by CalmSignal for product development and research. No individually identifiable data will be shared externally for commercial purposes.

7. Disclaimer of Warranties

To the extent permitted by German law, this website and all content, features, and services are provided on an as-is and as-available basis without warranty of any kind. The product is in active development. Its outputs are exploratory visualisations only and carry no warranty of accuracy, completeness, or fitness for any purpose.

8. Limitation of Liability

(a) CalmSignal shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with use of this website or the early access programme.

(b) CalmSignal shall not be liable for any health-related decision made by a user in connection with product outputs, for harm arising from reliance on outputs without independent medical consultation, or for any loss of data, service interruption, or technical failure.

(c) Nothing in these Terms limits or excludes: (i) liability for damages arising from injury to life, body, or health caused by negligent or intentional breach of duty pursuant to Paragraph 309 No. 7(a) BGB; (ii) liability for other damages caused by gross negligence or intentional misconduct; (iii) liability under the Produkthaftungsgesetz; or (iv) any other mandatory liability under German or EU law.

9. No Medical Advice — Standalone Notice

This notice forms part of these Terms and has independent legal effect

CalmSignal does not provide medical advice in any form. No information, output, visualisation, graph, or communication from CalmSignal should be interpreted as medical advice, clinical guidance, psychiatric assessment, or a recommendation regarding any health-related decision.

The product presents personal pattern data visually only. It draws no clinical conclusions. All interpretation is the sole responsibility of the user.

10. User Conduct

Users must not use this website or the early access programme for any unlawful purpose, to interfere with website infrastructure, to attempt to access data of other users, or to transmit harmful or fraudulent content. CalmSignal reserves the right to restrict or terminate access without notice or liability.

11. Confidentiality of Product Features

Early access participants are requested not to publicly share screenshots, detailed descriptions, outputs, or technical features of the CalmSignal product during the early access period. A formal non-disclosure undertaking forms part of Document 3.

12. Right of Withdrawal

Where the user is a consumer under Paragraph 13 BGB, a right of withdrawal exists for fourteen days from acceptance of these Terms, exercisable without stating reasons by written notice to contact@calm-signal.com. As participation is free of charge, no financial settlement arises. Data collected prior to withdrawal will be deleted upon written request.

13. Changes to Terms

Material changes will be communicated to registered users by email at least fourteen days before taking effect in accordance with Paragraph 308 No. 4 BGB. Continued participation following notification constitutes acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms are governed exclusively by the laws of the Federal Republic of Germany, excluding the CISG. For consumers under Paragraph 13 BGB, mandatory consumer protection provisions of the law of the user's country of habitual residence apply where they afford greater protection. Disputes not resolved by negotiation are subject to the exclusive jurisdiction of the courts of Germany. The European Commission's online dispute resolution platform is accessible at ec.europa.eu/consumers/odr.
